With the IRS's employment tax audit initiative underway, companies should expect scrutiny over issues such as employee/independent contractor classification, fringe benefits, employee reimbursements, and executive compensation.
According to the Corporate Executive Board, worker classification continues to be a controversial issue, as rules are not entirely black and white. CEB says companies with U.S. operations should review the guide IRS agents use to classify workers and its tips for dealing with employment tax audits, as well as monitor situations that may trigger an audit, including, 1) complaints from workers or competitors, 2) unemploymenet claims made by "contractors", 3) a large proportion of 1099 forms to W-2s, and 4) discrepancies on wages between various payroll tax forms.
